These Terms of Use (“Terms”) are an agreement between you and RedTracker LLC (“RedTracker”, “we”, “us”, “our”), the publisher of Telesto: Inventory Management. They apply to the Telesto apps for phones, tablets and desktop and to the website www.telesto.app (together, “Telesto”). By creating an account or using Telesto, you agree to these Terms. If you do not agree, please do not use Telesto. Our Privacy Policy explains how we handle information and forms part of these Terms.

Who can use Telesto

Telesto is a business tool for managing inventory. You must be at least 16 years old to use it, and if you use Telesto on behalf of a business or other organization, you confirm that you are authorized to accept these Terms on its behalf. We grant you a personal, non-exclusive, non-transferable, revocable license to use Telesto on devices you own or control, for your own business or personal use, subject to these Terms and to the rules of the store you downloaded it from.

Your account

You need an account to use Telesto. You are responsible for keeping your password and access to your account secure, and for everything that happens under your account. You agree to provide accurate information and to keep it up to date. If you invite employees or teammates to your account, you are responsible for their use of Telesto and for making sure they follow these Terms. Tell us right away if you believe your account has been used without your permission. We may suspend or close an account that violates these Terms, that creates risk or legal exposure for us, or that has been inactive for a long time.

Your data and content

The information you enter into Telesto, such as your products, stock, locations, orders, documents and the details of your customers and suppliers (“Content”), belongs to you. You are responsible for your Content, for having the right to provide it, and for using it in line with applicable laws, including data-protection and privacy laws where you record information about other people. You grant us permission to store, copy, process and display your Content only as needed to provide Telesto to you and the people you invite. We do not sell your Content, and we do not use it for advertising. We may remove Content that we reasonably believe violates these Terms or the law.

Acceptable use

You agree not to: (a) use Telesto for any unlawful purpose; (b) misuse or overload the Service, for example by sending automated or excessive requests; (c) try to bypass subscription checks, usage limits or other security features; (d) copy, modify, reverse engineer or redistribute the app, except where the law allows it; (e) upload malicious code or attempt to gain unauthorized access to Telesto, its servers or other users’ accounts; or (f) interfere with anyone else’s use of Telesto. We may limit, suspend or end access to Telesto or its online features if you break these Terms.

Plans, billing and subscriptions

Telesto offers a free plan and optional paid plans that unlock additional capacity and features. The features included in each plan may change over time.

Purchases. Paid plans are sold through the Apple App Store or Google Play, and payment is charged to your Apple or Google account when you confirm the purchase. We never receive or store your card details.
Automatic renewal. Subscriptions renew automatically at the end of each period, at the then-current price, unless you cancel at least 24 hours before the end of the current period.
Cancelling. Manage or cancel your subscription in your App Store or Google Play account settings. Cancelling stops future renewals; you keep your paid features until the end of the period you already paid for.
Refunds. Refunds are handled by Apple or Google under their policies. We cannot issue refunds for purchases made through their stores.
Price changes. We may change plan prices. Price changes follow the rules of the App Store and Google Play, which may include notifying you and asking for your consent before a higher price applies.

Availability, changes and your records

We work to keep Telesto useful and available, and your data is stored on our servers so you can reach it from your devices. Even so, we cannot guarantee that the Service will always be available or uninterrupted, or that data can never be lost, so you should keep your own records of anything that matters to you. Telesto lets you export your data, for example to a spreadsheet, and you can delete your account and its data at any time from the app. We may change, add or remove features, or stop offering Telesto or some of its features. If we stop offering a paid plan, we will follow the App Store and Google Play rules for active subscriptions.

App stores

If you downloaded Telesto from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies, and these Terms supplement it. If you downloaded it from Google Play, Google Play’s terms also apply. Apple and Google are not responsible for Telesto or its content, maintenance, support or warranties, and they are not a party to these Terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Intellectual property

Telesto, including its design, graphics, text and software, belongs to RedTracker LLC or its licensors and is protected by intellectual property laws. These Terms do not give you any right to use our name, trademarks or logos. Other trademarks mentioned in Telesto belong to their owners.

Disclaimer

Telesto is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Telesto will be uninterrupted or error-free, that it will meet your requirements, or that data will never be lost. Some countries do not allow these exclusions, so some of them may not apply to you.

Limitation of liability

To the fullest extent permitted by law, RedTracker LLC and its owners, employees, agents, suppliers and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of, or inability to use, Telesto. Our total liability for any claim relating to Telesto is limited to the greater of one US dollar or the amount you paid us for Telesto in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

Indemnification

You agree to indemnify and hold RedTracker LLC harmless from any claims, damages and costs (including reasonable attorneys’ fees) arising from your Content, your use of Telesto, or your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Any dispute relating to these Terms or Telesto will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction. If you live in a country whose consumer-protection laws give you the right to bring claims in your own country’s courts or under its laws, those rights are not affected. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and the applicable app store terms, are the entire agreement between you and us about Telesto.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. If you keep using Telesto after an update, you accept the updated Terms.
